Billions of dollars are on the line at the Olympics — but not for athletes.

There is a <a href="https://www.nytimes.com/2021/06/21/sports/olympics/tokyo-olympics-happening-why.html">ton of money</a> to be made at the Olympics, <a href="https://www.vox.com/22428596/olympics-tokyo-2021">even in a year like this</a>. NBC has <a href="https://money.cnn.com/2014/05/07/news/companies/nbc-olympics/index.html">paid</a> $7.7 billion for broadcasting rights to show the Olympics through 2032, and its <a href="https://www.nytimes.com/2020/03/04/business/media/nbc-
olympics-coronavirus.html">already sold</a> $1.25 billion in ads for the Tokyo games. The Associated Press <a href="https://apnews.com/article/tokyo-business-health-coronavirus-pandemic-2020-tokyo-
olympics-1ea9a7973b39c84b219934149cca160b">estimates</a> the International Olympic Committee (IOC), which runs the Olympic Games, stands to make $3 billion to $4 billion on television rights for the delayed 2020 Olympics. One NBC executive <a href="https://fortune.com/2021/06/14/nbc-broadcast-2020-tokyo-olympics-most-profitable-ever-coronavirus-
pandemic/">said</a> they believe this could be the most profitable Games ever.
</p>
<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="oNOFDf">
And yet, much of that wealth wont be shared with the events most valuable <a href="https://www.cnbc.com/2021/07/02/tokyo-olympics-present-
no-huge-risk-sebastian-coes-on-japan-games.html?__source=sharebar%7Ctwitter&amp;par=sharebar">assets</a>: the athletes themselves.
</p>
<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="UqOjTY">
Some 11,000 athletes are competing in the 2020 Olympic Games, and 4,000 athletes in the Paralympics (beginning in late August). There are more than 600 athletes just on Team USAs Olympic and Paralympic <a href="https://www.teamusa.org/News/2021/July/13/USOPC-Announces-613-Member-2020-US-Olympic-Team">roster</a>. (For the purposes of this story, Im going to focus mainly on American athletes.) The vast majority of those athletes are <a href="https://www.vice.com/en/article/jpz3dd/the-olympic-dream-being-a-poor-world-class-athlete">not</a><a href="https://www.fastcompany.com/3062575/olympic-athletes-struggle-financially-while-striving-for-gold"> rich</a>, or close to it.
</p>
<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="cQNCSN">
You cannot watch TV or exist on the internet right now without running into a Simone Biles ad. The Olympic gold medal gymnast got plenty of well-deserved, high-paying endorsement deals lined up. But she is the exception, not the rule. According to one <a href="https://www.usatoday.com/story/sports/olympics/2020/02/24/survey-finds-olympic-elite-athletes-struggling-
financially/111365842/">survey</a> of elite athletes from 48 countries, more than half are financially unstable. And that survey was taken before the pandemic, which made many competitors financial situations <a href="https://www.usatoday.com/story/sports/olympics/2020/05/13/tokyo-olympics-athletes-struggle-financially-no-
competitions/3113035001/">even worse</a> because so many competitions (that often translate to money) were canceled.

<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="eRqlEu">
“As impressive as someone like Simone Biles is or Michael Phelps has been, their stories get told and their achievements get reported on and analyzed. But there are incredible stories of people who really have to go work in regular jobs, depending on where they are in the world, to earn money just so they can live, and then theyre doing their training on top of it,” said Lee Igel, a clinical professor at the NYU Tisch Institute for Global Sport.

The romanticized vision of Olympic athletes is that theyre unpaid amateurs just doing it for the <a href="https://tmorris.utasites.cloud/sla/br170110.html">love of sport</a>. Since the 1970s, the international and US rules around amateurism and sponsorships have relaxed to make way for athletes to be compensated for their efforts and achievements. Financial restrictions have been dropped, and professional athletes are allowed to compete in almost all of the Olympic events, save wrestling.

<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="H5QkR8">
Still, theres room for improvement. US athletes striving toward the Olympics are generally left to their own devices in terms of funding training and travel for most of their careers, and even once they reach the top tier, they might receive a stipend that, while helpful, is not enough for most to live on. Lucrative sponsorship deals are not abundant. Big brands arent falling over themselves to make giant deals in sports such as judo or archery in the same way they might be for swimming or gymnastics, or take a risk on an athlete that might not make the Olympic cut.

“If youre not a household name, youre probably not on the top of the endorsement food chain,” said John Grady, a sports law professor at the University of South Carolina.
</p>
<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="HkNvjW">
Moreover, some of the restrictions around athlete sponsorships and endorsements make it harder for lesser-known competitors to capitalize on their Olympic moment in the sun. Under <a href="https://www.teamusa.org/team-
usa-athlete-services/athlete-marketing/ioc-rule-40-ipc-athlete-image-policy-guidelines">Rule 40</a>, put in place by the IOC in 1991, only official Olympic sponsors and partners — who have presumably spent a lot of money to be in that category — get full-throated rights around Olympic and athlete marketing during the Games. Every other company or brand is subject to a sort of <a href="https://olympics.com/athlete365/what-we-do/finance/rule-40/">blackout period</a> just before, during, and after the Olympics. While <a href="https://www.finnegan.com/en/insights/blogs/incontestable/let-the-
games-begin-usoc-eases-team-usa-rule-40-sponsorship-restrictions-ahead-of-tokyo-2020-olympics.html">loosened</a> this year, this is still a convoluted system that some experts and athletes say keeps current competitors from being able to strike more deals with non-Olympic partner brands and really cash in.

“Its a grave disservice and injustice to the athletes that theyre not able to really capitalize when they have the opportunity, every four years, to be on a global stage,” said Sanya Richards-Ross, who won gold in the 400 meters and 4x400 relay in the 2012 Summer Olympics in London and has been <a href="https://www.nytimes.com/2012/08/26/sports/olympics/sanya-richards-ross-fights-for-olympic-athletes-
rights.html">very outspoken</a> about athletes rights in the past. Even though she was one of the lucky ones who got big endorsement deals, she saw how it affected her teammates.
</p>
<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="Dm9wWk">
“The athletes that compete in the Olympics are not amateur, they do it full time. And who else would want to do something full time theyre great at and not get paid?” she continued. After all, she pointed out, everyone else — the IOC, the networks, and even the officials and support staff — is making money. The IOC doesnt even award prize money for the gold medal.

<h3 id="BrgWuw">
Olympic glory means being rich or getting a job
</h3>
<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="TOCwiL">
Every time the Olympics come around, there is a multitude of stories about athletes in dire financial straits — a rower <a href="https://www.espn.com/espnw/sports/story/_/id/15421001/us-rower-megan-kalmoe-money-struggles-olympians">living close to the poverty line</a>, a speed skater <a href="https://www.usatoday.com/story/sports/olympics/2013/07/01/olympic-hopefuls-struggle-financially/2481569/">applying for food stamps</a>, dozens of athletes starting <a href="https://www.washingtonpost.com/news/inspired-
life/wp/2016/07/06/the-hardest-part-about-making-the-olympics-for-these-americans-affording-it/">GoFundMe drives</a> to try to fund their ambitions. And these are people who have more or less made it in the sport, not to mention those who are still up-and-comers.
</p>
<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="vKJmOW">
“Theyre getting slammed up and down to be able to stay in the sport they love,” said John Nubani, a sports agent.
</p>
<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="zRL8XC">
Its not necessarily a secret that many athletes arent rich and that training for an elite sport is expensive. For years, Home Depot ran ads <a href="https://www.npr.org/templates/story/story.php?storyId=99175024">about how many Olympians it employed</a>, drawing attention to the idea that many people had jobs while they were competing. Still, many Americans assume that athletes get more financial support than they do.

Many countries have a ministry of sports that helps to fund their Olympic programs, but thats not the case in the United States. Instead, its run by the United States Olympic &amp; Paralympic Committee (USOPC), a private entity established in 1978 that <a href="https://www.wsj.com/articles/coronavirus-fallout-prompts-u-s-olympic-
paralympic-committee-to-cut-budget-10-20-11587492104">funds itself</a> through sponsorships and a cut of broadcast rights. Each sport is overseen by a national governing body, like USA Track &amp; Field or USA Wrestling, which fundraise on their own, too.
</p>
<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="3bLNW1">
Dionne Koller, director of the University of Baltimores Center for Sport and the Law, noted that theres something individualistic and, indeed, capitalistic about Americas approach to the Olympics — and intentionally so. The current setup was devised in the midst of the Cold War during the 70s, when it was determined that the private sector should be in charge of fostering athletes, she explained. At the time, many Soviet countries <a href="https://globalsportmatters.com/business/2018/10/15/professional-athletes-1968-olympic-
games/">were already secretly paying</a> their athletes like professionals anyway, and the US was looking for a way to compete. “Its very consistent with American norms; its a very American system. Its individuals pursuing individual dreams, and in doing so, they certainly wear the uniform of Team USA, but its individual, its not collective,” she said.
</p>
<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="uceixA">
US athletes are still generally much better off financially than many of their counterparts worldwide — theres a reason the US wins so many medals. But its striking that the representatives on the world stage of this incredibly rich country arent well compensated. And because of the financial barriers, many athletes with potential likely get screened out.
</p>
<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="S64mIU">
The USOPC has in place <a href="https://www.teamusa.org/Team-
USA-Athlete-Services/Financial-Resources">programs</a> to support athletes, such as grants to the national governing bodies and to top performers. National governing bodies often provide stipends to their top athletes, but those can vary from sport to sport (<a href="https://www.usatoday.com/story/sports/olympics/2013/07/01/olympic-hopefuls-struggle-
financially/2481569/">or even be cut</a>). According to <a href="https://www.usatoday.com/story/sports/olympics/2020/05/13/tokyo-olympics-athletes-struggle-financially-no-
competitions/3113035001/">USA Today</a>, track and field stipends top out at about $1,000 a month, and for weightlifters, it can range from $750 to $4,000.
</p>
<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="OvSs8S">
For Olympic wrestlers, stipends for the three top- ranked team members across each category are $1,000 a month for the top-ranked athlete, $600 for second, and $300 for third. Its something, but its not a living wage.
</p>
<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="MvZcOh">
“As a general rule in wrestling, most of our athletes that are trying to make the Olympic team are poor. Theyre putting off their careers and their moneymaking until after their Olympic dream is met or not,” said Steve Fraser, who is in charge of donor and alumni relations at USA Wrestling.

Its almost a given that competitors are going to have to work. Fraser knows what its like — he is a former Olympic wrestler and won a gold medal in 1984. He worked as a sheriffs deputy in Michigan while training. “I did my training before work at 6 am and I did my training after work,” he said. “Luckily, I had a supportive sheriff.”
</p>
<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="daG5cg">
Even when athletes win at the Olympics, the award money isnt life-changing. (And again, the IOC doesnt give out prize money for medals at all.) The USOPCs “Operation Gold” hands out $37,500 to gold medalists, $22,500 to silver medalists, and $15,000 to bronze in both the Olympics and, <a href="https://www.businessinsider.in/sports/news/us-paralympic-athletes-will-receive-equal-pay-for-the-first-time-at-
the-tokyo-olympics/articleshow/84616747.cms">this year for the first time</a>, the Paralympics. Bonuses depend on the prize money from the national governing body: USA Wrestling gives $250,000 to gold medalists. USA Track &amp; Field, by comparison, in 2015 <a href="https://www.runnersworld.com/news/a20854152/elite-runners-praise-new-usatf-payment-
model/">agreed</a> to give gold medalists $25,000.
</p>
<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="SiyMUA">
The USOPC says that much of its budget goes toward programs and activities that support athletes, such as training sites, media promotion, and <a href="https://2019impactreport.teamusa.org/high-performance-programs.html">high-performance programs</a> aimed at people who have the best shot at winning.
</p>
<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="MhAMrZ">
Olympic organizers and governing bodies say theyve struggled financially themselves, especially in the pandemic. The Associated Press <a href="https://apnews.com/article/virus-
outbreak-ap-top-news-olympic-games-sports-general-basketball-6d28d5af9c8151b82668609a0f45d5dd">estimates</a> that the majority of US governing bodies applied for pandemic-related PPP loans — USA Wrestling, for example, <a href="https://projects.propublica.org/coronavirus/bailouts/loans/usa-wrestling-4719767009">got</a> $680,000. And the USOPC <a href="https://www.wsj.com/articles/coronavirus-fallout-prompts-u-s-olympic-paralympic-committee-to-cut-
budget-10-20-11587492104">said</a> it would need to cut its budget amid the Covid-19 outbreak. Some of this has come with controversy: USA Track &amp; Field <a href="https://www.washingtonpost.com/sports/2020/04/23/usa-track-field-
defends-ceos-42-million-2018-salary-number/">came under scrutiny</a> over the size of its CEOs pay amid layoffs in 2020, and it was reported that the USOPC unsuccessfully <a href="https://www.washingtonpost.com/sports/2020/03/26/usopc-
asked-200-million-federal-stimulus-money/">lobbied</a> lawmakers for money in a stimulus package from Congress.
</p>
<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="gtSrK0">
Moreover, given all of the money that the Games and Olympic committee and governing bodies take in through sponsorships, donations, and broadcasting rights, its hard not to ask whether athletes could and should get a bigger piece of the pie.
</p>
<h3 id="4EY1cs">
The tangled web of Olympic sponsorship rules
</h3>
<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="7xQUGp">
Sprinter Christina Clemons earned a ticket to Tokyo when she placed third in the 100-meter hurdles at the US Olympic Trials in June while wearing <a href="https://www.tmz.com/2021/06/21/united-states-track-christina-clemons-doritos-earrings-
olympic-trials/">Cool Ranch Doritos earrings</a>. Days later, Doritos <a href="https://twitter.com/Doritos/status/1414688309717110788?s=20">announced</a> that Clemons would be its latest partner, and she thanked the brand for making their relationship official.
</p>
<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="abcwUn">
During the Olympics, however, its likely that Clemons and Doritos will face limits on how much they can talk about each other and in what capacity. Doritos parent company is PepsiCo, which is not an official Olympic partner. Its direct competitor, Coca-Cola is. A representative for Doritos didnt respond to a request for comment.

Under the aforementioned <a href="https://olympics.com/athlete365/app/uploads/2021/02/2021-02-03-Tokyo-2020-Commercial-Opportunities-for-Athletes-
Key-Principles-FINAL.pdf">Rule 40</a> out of the IOC, athletes are limited to how their names, images, or performances can be used during the Olympics without the IOCs permission. The same goes for certain Olympic language and symbols, such as the rings. The rules <a href="https://www.si.com/olympics/2016/07/25/rule-40-explained-2016-olympic-
sponsorship-blackout-controversy">aim</a> is to “preserve the unique nature of the Olympic Games by preventing over- commercialization. (Which might confuse the people who take in all the Olympics-sanctioned advertising.) Its also to protect Olympic partners from “<a href="https://en.wikipedia.org/wiki/Ambush_marketing">ambush marketing</a>” by a rival. Many athletes and <a href="https://www.huffpost.com/entry/how-the-ioc-effectively-m_b_11520516">experts</a> have complained that it keeps athletes from capitalizing on their Olympic success by barring them from seeking out their own sponsors.
</p>

The rule has been controversial, especially among athletes at the Summer Olympics. In 2012, London Olympians protested the rule with a <a href="https://www.nytimes.com/2012/07/31/sports/olympics/athletes-at-
olympics-protest-sponsorship-rule-on-twitter.html">#WeDemandChange campaign</a> calling for adjustments. The rule was <a href="https://www.swimmingworldmagazine.com/news/a-relaxed-rule-40-will-allow-athletes-greater-endorsement-
opportunities-at-tokyo-games/">relaxed</a> slightly heading into the 2016 Olympics in Rio de Janeiro, but in the eyes of many, it wasnt enough.

<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="bQCYC5">
“Rule 40 has tried — and Im using air quotes — to give more opportunities to lesser-known athletes, but that has not quite materialized in any real way,” Gracy, the South Carolina professor, said.
</p>
<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="rDAh7U">
For Tokyo, the rules are relaxed even more, but theyre still quite restrictive. US athletes can post seven thank-you messages referencing their personal sponsors during the Games, and their sponsors can congratulate them one time. But the language they can all use is limited. It has to be generic and cant use any Olympic or Paralympic intellectual property, meaning no Olympic rings or “Tokyo 2020” or “Team USA.”

How effective the rule changes will be for helping lesser-known athletes get more sponsorships during their moment in the spotlight remains to be seen. Brands may not want to take a risk on these athletes, and companies and athletes may be afraid of accidentally breaking the rules. Richards-Ross said she still believes organizers could loosen their grip more. “Its made to make it too difficult for athletes to be able to profit,” she said.

She was a <a href="https://www.sportsbusinessjournal.com/Daily/Issues/2012/08/27/Marketing-and-
Sponsorship/Rule-40.aspx?ana=register_free_form_2_filled">leader</a> of the #WeDemandChange campaign in 2012 and said, given her experience, some competitors may be afraid to speak out. “I cant tell you how many emails I got from people telling me that I should be grateful to represent Team USA and if Im going to be money-hungry to go back to Jamaica,” she said. This type of public sentiment — that the Olympics are for amateurs who should just feel honored to be there — provides cover for the IOC and USOPC in the way they financially treat athletes. “Its unfair that theyre able to keep that sentiment that it solely is an honor. I dont think those two things are mutually exclusive. It can be a tremendous honor to represent your country, and you can also be financially rewarded for your efforts.”

<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="jZKpFJ">
US organizers are <a href="https://www.sportsbusinessjournal.com/SB-Blogs/Breaking-News/2020/11/USOPC.aspx">piloting</a> a new athlete marketing platform meant to better help athletes earn money. But how lucrative it will be is an open question. For example, athletes can opt into a group marketing option and receive $1,250 a year for the USOPC for appearances in marketing campaigns. Its a decent bonus, not a livable paycheck. “There needs to be a better way for athletes to go out and make money, but this isnt it,” said Brant Feldman, senior managing partner at American Group Management, which represents Olympic and Paralympic athletes.

Sports are a multibillion-dollar industry. So why dont we treat athletes like it?
</h3>

The US is entering the Olympics on the heels of some major developments in college athlete compensation. A <a href="https://www.vox.com/2021/6/21/22543598/supreme-
court-ncaa-alston-student-athletes-football-basketball-sports-antitrust">Supreme Court decision</a> opened the door to student-athlete payments, and an NCAA <a href="https://www.nytimes.com/2021/06/30/sports/ncaabasketball/ncaa-nil-
rules.html">rule change</a> allowed athletes to <a href="https://www.vox.com/the-goods/22242503/ncaa-college-athletes-
endorsement-rule">monetize their personal brands and seek out endorsements</a>. These advances have been years in the making, and could potentially put wind in the sails of the conversation around how Olympians are paid. But one big barrier is that the Olympics are intermittent. While the athletes spend day in and day out training, the issue only arises among the public when the competition is actually happening.

<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="FTiL7X">
I asked experts what they thought could be done to boost athletes financially and fix the system, and the answers ran the gamut.
</p>
<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="2z8yPZ">
Feldman, rather unsurprisingly, thinks it would be better if more athletes had agents. But he also suggested they should be able to bargain collectively or even establish some kind of a floor rate for appearing in commercials and advertisements, <a href="https://www.sagaftra.org/production-center/contract/802/rate-sheet/document">like SAG-AFTRA has for entertainers</a>. “It would be really great if there were some sort of entity, like a union, that would be negotiating on behalf of all of the athletes for a floor,” he said. “That at least, to me, gives Olympic and Paralympic athletes a better idea of what the minimum should be for any of the content that gets shot across the board.”

Nubani, an agent who works mainly with track and field athletes, said he believes it comes down to brands or very wealthy people being willing to put more money into USA Track &amp; Field — and that money being distributed to athletes. He also emphasized the need for prize money for medalists. “If youre not a superstar and you didnt do something really specifically special at the Olympics … you may not get that big sponsor deal, you may not get the Wheaties box, you may not get the things other superstar athletes will get,” he said.
</p>
<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="WwGb4H">
Koller, who was recently <a href="https://sportslawexpert.com/2021/04/03/koller-hogshead-makar-named-to-the-commission-on-the-state-of-the-united-
states-olympic-and-paralympic-committee/">named</a> to the USOPC Commission appointed by the US Senate, suggested there could be a discussion about whether the federal government should, like other countries, do more to support sports, not only for elite athletes but for those on the way there. “When you wear Team USA, youre giving a public good,” Koller said. Or, at the very least, athletes competing in the same sport should be required to receive the same compensation, which is part of <a href="https://www.cantwell.senate.gov/news/press-releases/cantwell-capito-introduce-bipartisan-
legislation-for-equal-pay-for-all-athletes-competing-under-the-american-flag">legislation</a> introduced in Congress.
</p>
<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="XfcAry">
The 2020 Olympics are going to be quite different from Olympics past, including their economics. Brands looking to sell to a local audience are <a href="https://www.wsj.com/articles/tokyo-olympics-sponsors-
spent-big-bucks-but-their-plans-are-falling-flat-11626175499">stuck without spectators</a> because of Covid-19; organizers <a href="https://apnews.com/article/sports-2020-tokyo-olympics-business-health-coronavirus-
pandemic-915d4104f9affc21c927d8818860429e">wont be able to hobnob</a> with sponsors like they would in normal times. One constant: The athletes remain the stars of the show. And its important to think about whether they should be paid more like it.

One of the worst-case scenarios for the barely regulated and secretive location data industry has become reality: Supposedly anonymous gay dating app data was apparently sold off and linked to a Catholic priest, who then resigned from his job.
</p>
<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="8BX1wo">
It shows how, despite app developers and data brokers frequent assurances that the data they collect is “anonymized” to protect peoples privacy, this data can and does fall into the wrong hands. It can then have dire consequences for users who may have had no idea their data was being collected and sold in the first place. It also shows the need for real regulations on the data broker industry that knows so much about so many but is beholden to so few laws.
</p>
<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="i3tPTc">
Heres what happened: A Catholic news outlet called the Pillar somehow obtained “app data signals from the location-based hookup app Grindr.” It used this to track a phone belonging to or used by Monsignor Jeffrey Burrill, who was an executive officer of the United States Conference of Catholic Bishops. Burrill resigned his position shortly before the Pillar published <a href="https://www.pillarcatholic.com/p/pillar-investigates-usccb-gen-sec">its investigation</a>.
</p>
<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="bjLRVh">
Theres still a lot we dont know here, including the source of the Pillars data. The report, which presents Burrills apparent use of a gay dating app as “serial sexual misconduct” and inaccurately conflates homosexuality and dating app usage with pedophilia, simply says it was “commercially available app signal data” obtained from “data vendors.” We dont know who those vendors are, nor the circumstances around that datas purchase. Regardless, it was damning enough that Burrill left his position over it, and the Pillar says its possible that Burrill will face “canonical discipline” as well.
</p>
<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="DJ8wgn">
What we do know is this: Dating apps are a <a href="https://www.vox.com/recode/2020/2/14/21137096/how-tinder-matches-work-algorithm-grindr-bumble-hinge-
algorithms">rich source of personal and sensitive info</a> about their users, and those users rarely know how that data is used, who can access it, and how those third parties use that data or who else they sell it to or share it with. That data is usually supposed to be “anonymized” or “de-identified” — this is how apps and data brokers claim to respect privacy — but it can be <a href="https://www.vice.com/en/article/epnmvz/industry-unmasks-at-scale-maid-to-pii">pretty easy</a> to re-identify that data, as <a href="https://www.nytimes.com/interactive/2018/12/10/business/location-data-
privacy-apps.html">multiple</a> <a href="https://www.nytimes.com/2021/02/05/opinion/capitol-attack-cellphone-
data.html">investigations</a> <a href="https://www.nytimes.com/interactive/2019/12/19/opinion/location-tracking-cell-
phone.html">have shown</a>, and as privacy experts and advocates have warned about for years. Considering that data can be used to ruin or even end your life — being gay is <a href="https://www.bbc.com/news/world-43822234">punishable by death</a> in some countries — the consequences of mishandling it are as severe as it gets.
</p>
<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="EUlmuS">
“The harms caused by location tracking are real and can have a lasting impact far into the future,” Sean OBrien, principal researcher at ExpressVPNs Digital Security Lab, told Recode. “There is no meaningful oversight of smartphone surveillance, and the privacy abuse we saw in this case is enabled by a profitable and booming industry.”
</p>
<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="uWEbue">
For its part, Grindr <a href="https://www.washingtonpost.com/religion/2021/07/20/bishop-misconduct-resign-
burrill/">told the Washington Post</a> that “there is absolutely no evidence supporting the allegations of improper data collection or usage related to the Grindr app as purported” and that it was “infeasible from a technical standpoint and incredibly unlikely.”
</p>
<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="Lzewdq">
Yet Grindr has gotten in trouble for privacy issues in the recent past. Internet advocacy group Mozilla labeled it as “privacy not included” in its <a href="https://foundation.mozilla.org/en/privacynotincluded/categories/dating-apps/">review of dating apps</a>. Grindr was <a href="https://www.nytimes.com/2021/01/25/business/grindr-gdpr-privacy-fine.html">fined nearly $12 million</a> earlier this year by Norways Data Protection Authority for giving information about its users to several advertising companies, including their precise locations and user tracking codes. This came after a nonprofit called the <a href="https://www.nytimes.com/2020/01/13/technology/grindr-apps-dating-data-tracking.html">Norwegian Consumer Council found</a> in 2020 that Grindr sent user data to more than a dozen other companies, and after a 2018 <a href="https://www.buzzfeednews.com/article/azeenghorayshi/grindr-hiv-status-privacy">BuzzFeed News investigation</a> found that Grindr shared users HIV statuses, locations, email addresses, and phone identifiers with two other companies.
</p>
<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="UTwI0h">
While its not known how Burrills data was obtained from Grindr (assuming, again, that the Pillars report is truthful), app developers usually send location data to third parties through <a href="https://www.vox.com/recode/2020/7/8/21311533/sdks-tracking-data-location">software development kits</a>, or SDKs, which are tools that add functions to their apps or serve ads. SDKs then send user data from the app to the companies that make them. As an example, <a href="https://www.vice.com/en/article/jgqm5x/us-military-location-data-xmode-
locate-x">thats how</a> data broker X-Mode was able to get location data from millions of users across hundreds of apps, which it then gave to a defense contractor, which then gave it to the US military — which is far from the only <a href="https://www.vox.com/recode/22038383/dhs-cbp-investigation-cellphone-data-brokers-venntel">government agency</a> sourcing location data this way.
</p>
<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="ayGzWO">
Grindr did not respond to a request for comment from Recode asking for details on which companies or third parties it shared or sent user data to, or which SDKs it uses in its app. But it does say <a href="https://www.grindr.com/privacy-policy/?lang=en-US">in its own privacy policy</a> that it shared users age, gender, and location with advertisers until April 2020. The Pillar said its data on Burrill is from 2018 to 2020.
</p>
<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="k4UpcD">
Companies sell this data with ease because the data supply chain is opaque and the practice is barely regulated, especially in the United States. The $12 million fine from Norway was because Grindr violated the European Unions General Data Protection Regulation, or GDPR. The United States still doesnt have an equivalent federal privacy law, so Grindr may not have done anything legally wrong here unless it lied to consumers about its privacy practices (at which point it may be subject to Federal Trade Commission penalties, <a href="https://www.pcmag.com/news/ftc-gives-zoom-a-slap-on-the-wrist-for-past-privacy-security-
lapses#:~:text=Video%20Conferencing%20Software-,FTC%20Gives%20Zoom%20a%20Slap%20on%20the%20Wrist%20for%20Past,of%20the%20video%2Dconferencing%20service.">such as they are</a>).
</p>
<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="Ekt9hF">
“Experts have warned for years that data collected by advertising companies from Americans phones could be used to track them and reveal the most personal details of their lives,” Sen. Ron Wyden (D-OR), who has <a href="https://www.wyden.senate.gov/news/press-releases/wyden-cassidy-and-bicameral-coalition-request-
ftc-investigate-advertisers-tracking-americans-at-places-of-worship-and-protests">pushed for privacy regulations</a> on the location data industry, said in the statement to Recode. “Unfortunately, they were right. Data brokers and advertising companies have lied to the public, assuring them that the information they collected was anonymous. As this awful episode demonstrates, those claims were bogus — individuals can be tracked and identified.”
</p>
<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="wlbrsr">
In the absence of laws, companies could regulate themselves to better protect users privacy. But without anything compelling them to do so — and in an environment where any transgressions are difficult to identify and track — the user is simply left to hope for the best. App stores like Apples and Google Play do forbid selling location data in their terms of service, but we know some companies <a href="https://www.vox.com/recode/22278402/x-mode-sdk-google-play-ban-
location-data">do it anyway</a>. If Apple or Google finds out that apps are breaking those rules, they <a href="https://www.vice.com/en/article/g5bjpx/apple-google-x-mode-xmode-app-stores">may ban them</a> from their stores. But that doesnt help the people whose data was already collected, shared, or sold.
</p>
<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="KbuvUj">
So, what can you do? If you use Grindr and want to minimize or restrict any data you may have given to the app, its privacy policy has some details on how to opt out of advertising services and delete your account. Then you have to trust that Grindr will follow through … just like you had to trust that Grindr would protect your data in the first place.
</p>
<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="ZWeWrD">
You can also advocate for privacy laws that forbid these practices from happening at all, by contacting your local and federal representatives. 2021 has seen the passage of two state-level privacy laws (<a href="https://iapp.org/news/a/virginia-passes-the-consumer-data-protection-act/">Virginia</a> and <a href="https://iapp.org/news/a/colorado-privacy-act-becomes-law/">Colorado</a>), but were still waiting for a federal law. Though Democrats have the presidency, House, and Senate (barely, and <a href="https://www.vox.com/videos/2019/6/17/18681798/filibuster-senate-broke-video">still not enough</a> without filibuster reform), they have <a href="https://www.politico.com/news/2021/06/01/washington-plan-protect-american-data-
silicon-valley-491405">yet to advance</a> any of the privacy bills proposed — and the year is more than half over.
</p>
<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="vndacH">
The simple fact is, the data you give to apps powers a massive economy worth <a href="https://techcrunch.com/2020/07/09/data-brokers-tracking/">hundreds of billions of dollars</a>, which is hundreds of billions of reasons for it not to change — until and unless its forced to.
</p>
<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="qylHLW">
“The FTC needs to step up and protect Americans from these outrageous privacy violations, and Congress needs to pass comprehensive federal privacy legislation,” Wyden said.

The future of the Senates two-track strategy on infrastructure is uncertain.

Senate Democrats are navigating a tricky balancing act: attempting to simultaneously advance both a $600 billion bipartisan infrastructure bill and a $3.5 trillion budget resolution full of Democratic priorities thats only expected to garner partisan support.
</p>
<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="gjsrVK">
This plan, which has colloquially been referred to as the “two-track strategy,” is intended to demonstrate that lawmakers can actually work across party lines to get something done on “hard” infrastructure, like <a href="https://www.vox.com/22534714/rail-
roads-infrastructure-costs-america">roads</a> and <a href="https://www.vox.com/e/22341700">airports</a>, and that Democrats can also deliver on “human” infrastructure thats a party priority but that Republicans wont support, like funding for long-term caregiving and paid leave.
</p>
<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="imJNXL">
It is a somewhat circuitous approach to approving infrastructure legislation, driven by the focus that moderate Democrats, and President Joe Biden, have put on bipartisanship — as well as their refusal to alter the filibuster.
</p>
<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="XZD0cz">
Democrats from the get-go could have simply passed one bill including their key provisions via budget reconciliation, which requires only a simple majority. But theyd need all 50 members of the caucus, and moderates like Sen. Joe Manchin (D-WV) have said they <a href="https://www.axios.com/joe-manchin-infrastructure-bill-c8408e99-17f3-4477-b5df-8e3d537c0bd9.html">wouldnt consider that approach</a> without an attempt to do a bipartisan measure first.
</p>
<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="QNOSF0">
So, bipartisanship. But that measure wouldnt be enough for Democrats, even if it does pass. Theyve instead allocated many of their additional priorities, such as universal pre-K and extensions to the child tax credit, to a reconciliation measure, because Republicans have said firmly that they wont be supporting them in a bipartisan bill.

<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="jsZ8Me">
The next two weeks will be telling for the two-track strategy: So far, there are no guarantees on either track. On Wednesday, the bipartisan bill failed to get the 60 votes it needed to make it through a procedural vote, because the text for the legislation isnt done yet and Republicans have said they wont vote on opening debate until it is. Schumer, meanwhile, has emphasized that on other bills like the Innovation and Competition Act, and the Covid-19 Hate Crimes Act, Congress has voted to proceed to debate even without the full text.

The partisan track is uncertain, too: Senate Democrats have yet to announce an agreement on the budget resolution outline, though Sen. Bernie Sanders (I-VT) told reporters on Wednesday that he felt theyd meet Schumers deadline to do so before the end of the day.

Things could still work out in both cases, but it depends a lot on what happens in the next week.

A group of 11 moderate Republicans have said theyd vote in favor of advancing bipartisan legislation by Monday, if they come to a deal by then. Senate Democrats, too, could rally behind their budget measure at that point.

How the two-track solution will work, in theory

If Schumer pulls off the strategy — and thats an enormous if — then Congress could effectively open the door to $4.1 trillion worth of new spending before lawmakers take their recess for the month of August.

A lot has to go right between now and then, however.
</p>
<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="2XEYwt">
The first step is to advance the Bipartisan Infrastructure Framework. Now that the Wednesday procedural vote has failed, it remains to be seen whether the outcome will be different for a potential Monday vote on the bill. Moderate Republicans have said that they opposed opening debate on the legislation on Wednesday because it wasnt fully written at that point; so far, the negotiators have yet to finalize an agreement and produce legislative text. Republican negotiators have said they intend to support the bill if it comes up for another vote on Monday, if a deal is actually struck. Whether they will reach this agreement, though, isnt yet certain.

“I am hoping that Sen. Schumer will have the vote on Monday when weve had a chance to resolve any remaining, outstanding issues,” Sen. Mitt Romney (R-UT), a member of the bipartisan negotiating group, <a href="https://www.cnn.com/2021/07/21/politics/senate-vote-bipartisan-infrastructure-
plan/index.html">told CNN</a>.

<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="4JXBmi">
Schumer had previously said that he scheduled the Wednesday vote this week to pressure negotiators to make progress on the legislation. Hes also emphasized that such practices have been used on other bills in the past, and that its not uncommon to open debate on a measure before the text is completed.

<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="7uC3tJ">
Although theres still no legislative text, the BIF — as its outline lays out — focuses on whats considered more traditional infrastructure. Of the $579 billion in new spending it contains, theres $312 billion for transportation, $109 billion for roads and bridges, $55 billion for water infrastructure, and $65 billion for broadband infrastructure, among its provisions. It does not, however, include funding for long-term caregiving or a number of the climate measures that were part of Bidens original American Jobs Plan.

<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="lo7Bvm">
At this point, lawmakers still have to vote on opening up debate on the legislation, as well as on the legislation itself. If the final legislation is filibustered, all 50 Democrats plus at least 10 Republicans, or some other combination of a bipartisan group, would be needed to meet the 60-vote threshold to approve the bill.

<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="Hmrpxk">
All of this is happening as Democrats weigh their budget resolution, which has $3.5 trillion in funding and includes an array of climate provisions as well as massive expansions to the social safety net. This measure would fund universal pre-K, paid family and medical leave, and an extension of the child tax credit. Wednesday is also the deadline that Schumer gave the Democratic caucus to unite and agree on this resolution, which Sanders has spearheaded.

<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="tXFMpU">
In order for that bill to pass via budget reconciliation, a process that allows spending- and tax-related bills to advance with a simple majority, Schumer needs all 50 members of his caucus to agree on both approving the resolution and the final bill.

<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="DgsBJN">
The measures in the budget bill will also need to be reviewed by the Senate parliamentarian, Elizabeth MacDonough, who can strip out provisions that she thinks are not relevant to taxing and spending. (Earlier this year, MacDonough ruled that a $15 minimum wage, for instance, could not be included in a budget bill.)

Democrats need to vote on the budget resolution — basically, instructions for what a bill should contain — first, as part of this process, since that lays out the areas the final legislation will cover. And Schumer has said he intends for them to do so before the August recess. Once they approve this resolution, lawmakers will have to write the actual budget bill, which wont get a floor vote until later this year.
</p>
<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="CUS3TT">
That means Congress will probably vote on the final<strong> </strong>bipartisan bill and the budget resolution around the same time, and then consider the final budget bill slightly later.
</p>
<h3 id="9bNdDV">
The two- track solution could work — but it has some major hurdles to overcome
</h3>
<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="WPbzE8">
There are a number of factors that will determine whether Schumers game of legislative maneuvering ends in the passage of both bills, just one, or none at all.
</p>
<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="cnjyXR">
On the BIF front, keeping the support of at least 10 Republicans is dicey. Firstly, the bipartisan group has to agree on the legislative text: Recent disagreements have centered on the role that IRS enforcement should play in funding the measure.
</p>
<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="mFgA7M">
The initial plan was to spend $40 billion bolstering IRS enforcement in order to generate $140 billion in new tax revenue — but then <a href="https://www.washingtonpost.com/business/2021/07/07/irs-taxes-budget-conservatives/">conservative groups marshaled their resources against that</a> (since it could result in crackdowns on wealthy individuals and companies evading taxes) and Republicans caved.<strong> </strong>Sen. Rob Portman (R-OH) said IRS funding was <a href="https://www.politico.com/news/2021/07/18/portman-irs-enforcement-infrastructure-package-499988">out of the bill</a>, leaving a $100 billion funding gap for the bipartisan group to fill.
</p>
<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="P0vCvd">
Barring an agreement on the pay-fors by next week — a nonnegotiable for Republicans who want the measure to be debt-neutral<strong> </strong>— the bipartisan measure has little chance of moving forward. If the differences between lawmakers get worked out, 11 Republicans have said theyll back the measure.
</p>
<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="khAwEo">
Meanwhile, House Democrats are also unlikely to consider the bipartisan plan without any more progress on the budget resolution.

In June, <a href="https://www.cnn.com/2021/06/24/politics/pelosi-bipartisan-bill-infrastructure-reconciliation-
democrats/index.html">Speaker Nancy Pelosi said</a> the House will not take up any bipartisan infrastructure deal until Senate Democrats have passed their budget resolution, as a guarantee to progressives that supporting the bipartisan bill will not result in a dead end for their other priorities. She has not backed down so far, and progressives in the House are unlikely to support the BIF if they think Senate Democrats will not be able to pass the $3.5 trillion budget measure.

<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="2HtFck">
If the budget resolution gets through the Senate, House moderates could still be a source of opposition, too. Democrats can only afford to lose four votes and still have the resolution pass, and several key moderates have not yet made their opinion known on the size and scope of the budget bill, <a href="https://www.nytimes.com/2021/07/14/us/politics/biden-social-spending-deal.html">per the New York Times</a>. But watering down the bill could, in turn, push away progressives.
</p>
<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="SWE7l0">
On the Senate side, Democrats similarly need to keep the entire caucus together. So far, signs are hopeful: Manchin is expected to support the budget bill so long as it is paid for and he approves of the energy and climate provisions, according to <a href="https://thehill.com/homenews/senate/563323-manchin-signals-hell-be-team-player-on-spending-deal">the Hill</a>, though that could change.

<p data-aos="fade-left" data-aos-anchor-placement="bottom-bottom" id="J3hA0m">
Simply put, there is no certainty that this two-track strategy will work.

In the event that the bipartisan agreement fails, Democrats could still attempt to pass all the infrastructure priorities via reconciliation. But at that point, maintaining Democratic unity on whatever that bill looks like would continue to be a major challenge.
